This Privacy Policy describes how Kristine Dugan, a licensed real estate broker with Hawaiʻi Life ("we," "us," or "I"), collects, uses, and shares information you provide through housesforsalekauai.com (the "Site"). By submitting any form on this Site, you agree to the practices described below.

1. Information I Collect

I collect information you voluntarily provide through contact forms, lead capture forms, and resource download requests. Depending on the form, this may include:

• First and last name
• Email address
• Phone number
• Property interests, address, or details you share in a message
• The specific resource or service you requested (e.g., market report, relocation guide)

I do not collect payment information, government ID numbers, or financial account details through this Site.

I also collect standard web analytics data (pages visited, time on site, general location, device type) through Google Analytics 4. This data is aggregated and not personally identifiable.

2. How I Use Your Information

Information you submit is used to:

• Respond to your inquiry or service request
• Deliver the resource you requested (market report, relocation guide, or similar)
• Follow up by phone, email, or text message regarding Kauaʻi real estate
• Send communications related to your real estate transaction or search

I do not use your information for unrelated marketing, sell it to third parties, or share it with advertisers.

3. SMS / Text Message Communications

• Message frequency: Varies based on your inquiry and communication preference. You will not receive unsolicited promotional blasts.
• Message and data rates may apply depending on your wireless carrier and plan.
• To opt out: Reply STOP at any time. You will receive one confirmation message and no further texts.
• For help: Reply HELP or contact me at KristineDugan@HawaiiLife.com.
• Opting out of SMS does not affect your ability to receive email follow-up or to work with me as your agent.
• No purchase is required to use or opt out of this SMS program.

4. Third-Party Data Processors

I use the following third-party services that may receive or process information you submit:

• Formspree — processes and stores form submissions on my behalf. Formspree acts as a data processor under their Privacy Policy.
• Follow Up Boss (FUB) — my primary real estate CRM. Lead submissions are routed to FUB, where your contact information is stored and used to manage our communication. Follow Up Boss is owned by Zillow. As of November 2025, Zillow's updated privacy policy allows sharing of data for contacts who are also Zillow users ("mutual customer data") between Zillow and FUB-connected agents. • Rechat — a real estate marketing and communication platform integrated with FUB. Limited contact data (such as name) may sync to Rechat as part of transaction management.
• Google Analytics 4 — collects anonymized website usage data. See Google's Privacy Policy.

None of these processors are authorized to use your data for their own marketing purposes independent of the services they provide to me.

5. Data Retention

Your information is retained for as long as it remains relevant to your real estate inquiry or transaction, or as required by applicable law. Form submissions stored in Formspree are retained indefinitely unless you request deletion. CRM records in Follow Up Boss are retained for the duration of our relationship and for a reasonable period thereafter.

6. Your Privacy Rights

California residents (CCPA): You have the right to know what personal information I collect, request deletion of your personal information, and opt out of the sale of your data. I do not sell personal information. To exercise these rights, contact me using the information in Section 8.

Hawaii residents: This Site operates in compliance with applicable Hawaii law, including Hawaii Revised Statutes Chapter 487N (security breach notification) and Chapter 480 (unfair and deceptive trade practices). While Hawaii does not currently have a comprehensive consumer privacy law, you may contact me at any time to access, correct, or request deletion of personal information I hold about you.

All users: You may request a copy of the information I hold about you, request correction of inaccurate information, or request deletion at any time by contacting me directly.

7. Deletion Requests

To request deletion of your personal information from my systems, contact me at KristineDugan@HawaiiLife.com with the subject line "Data Deletion Request" and include the name and email address you used when submitting a form. I will respond and confirm deletion within 30 days.

Please note that deletion from my systems removes your information from Formspree, Follow Up Boss, and Rechat to the extent reasonably possible. Some anonymized or aggregated records may be retained for operational or legal purposes.

8. Cookies and Tracking

This Site uses cookies placed by Google Analytics 4 to track anonymized usage data (pages viewed, session duration, general location). No advertising cookies or cross-site tracking cookies are used. You can disable cookies in your browser settings at any time without affecting your ability to use this Site.

The Site does not use pixel tracking, fingerprinting, or behavioral advertising technology.

9. Children's Privacy

This Site is intended for adults engaged in real estate decisions. I do not knowingly collect personal information from individuals under the age of 18. If you believe a minor has submitted information through this Site, please contact me immediately and I will delete it.

10. Changes to This Policy

I may update this Privacy Policy from time to time. When I do, the "Last updated" date at the top of this page will change. Continued use of this Site after an update constitutes acceptance of the revised policy. For material changes, I will make reasonable efforts to notify users who have submitted contact information.
